Current flat rate of statutory adoption pay

The current flat rate of statutory adoption pay (applicable after the first six weeks) is £151.97 per week from 4th April 2021 (or 90% of average weekly earnings if less).

The basic rights to adoption leave and pay are set out within the Employment Act 2002 and the Work and Families Act 2006, as amended. Broadly speaking, the rights of an individual who is adopting a child mirror those of pregnant employees.

In many schools and colleges these statutory rights are enhanced by an occupational adoption scheme, generally mirroring the maternity pay scheme, which may be either locally determined or derived from a collective agreement.
